Noise DJ Service's Shop Policies
General: The following terms and conditions outline SyndiMix Media Networks LLC, Noise DJ Service, DynaBooths, DJ Supe, employees and contractor responsibilities, herein referred to as "Seller" and the customer/clients, herein referred to as "Buyer" responsibilities. Seller agrees to provide services at the location indicated. Seller owns all picture and video rights and may use them for commercial and advertising material unless Buyer explicitly opts out in writing.
Technical Event Terms: Buyer must provide load and unload access to performance area within 100 feet of parking/loading location. For events requiring up to 3500 watts of peak power, Buyer must provide a minimum of two 15 amp electrical outlets on separate circuits accessible within 25 feet of Seller setup area unless advanced arrangements are made. For events requiring more than 3500 watts of peak power, Buyer must provide a minimum of three 15 amp electrical outlets on separate circuits or two 20 amp electrical outlets on separate circuits accessible within 25 feet of Seller setup area unless advanced arrangements are made.Buyer must pay for all parking fees and valet fees for the day or a valid parking pass upon performer arrival. Parking accessibility must be within 700 feet (1/8 of a mile) from contracted venue location.
Multi-Media Use: The Seller herein reserves the right to utilize photographs, video recordings, audio or other multi-media documentation of the event for purposes of Seller's own marketing. This may include images, audio, video, multi-media, or other transmissions of guests, hosts, owners, venue property or adjacent areas. The Buyer herein expressly authorizes any such usages by the Seller and/or its partners.
Payment Terms and Conditions: In exchange and consideration for deposit payment, Seller agrees to reserve services for Buyer on service date. If 7 days prior to Service Date(s) Buyer wishes to change the existing Service Date to a new Service Date, Buyer agrees to notify Seller via the invoice messaging system. In the event of such an occurrence, Buyer also agrees to provide Seller with an additional non-refundable deposit of $50 at the time of requested service date change. After 7 days, Buyer acknowledges that the Service Date is non-negotiable and it is at the Seller's sole discretion whether or not to consider a service date change. In the event of Buyer's cancellation, the initial 50% deposit is not refundable but can be used as a credit towards a future event or to a third party having an event occurring within 30 days of initial service date. After 30 days, the deposit is no longer eligible to be used towards another event and will be retained by Seller as payment for withholding services from the market for the time indicated. If Buyer cancels event in writing via email or via the invoice messaging system 7 days prior to the day of the event, only payments exceeding 50% of the full balance are refundable. After 7 days, no payments are refundable, however payments are transferable to a third party as a credit for services within 30 days of original service date.
The Buyer also understands the deposit, remaining balance payments made after the event date, or any additional fees are non-refundable under circumstances including but not limited to any act of God, natural disaster, pandemic, power failure, civil disobedience, miscommunication or misunderstanding with Buyer or Buyer's other contractees and/or affiliates involved with said event, lack of patronage, or Buyer's dissatisfaction thereof. The Buyer understands that neither the Seller nor any employees/sub-contractors of Seller assume any responsibility nor liability for any damages or vandalism to facility, indoor or outdoor areas including but not limited to; parking lots, surrounding facilities, or merchants within an infinite proximity to contracted venue location. This also includes any damages or injuries to any person(s) or property before, during or after said contracted event. Buyer thus understands and agrees that any remaining balance remains outstanding regardless of events turnout that is not deemed a deliberate and direct result of Seller's malicious performance or conduct and is due at the time indicated.
The Buyer understands if the final balance payment is not received within 30 calendar days of the event date, the Buyer's name and/or organization name will be submitted to collections and will incur an additional 5% surcharge of the full balance. This may also include derogatory marks on the Buyer's credit report. It is the Buyer's responsibility to contact the Seller if the contractual obligation cannot be met in a timely manner. Communication efforts will be made by the Seller, however if the Buyer does not receive communication from the Seller regarding any past due balance, such balance is still due at the time indicated.
Limitations: The aforementioned terms, and any other documentation shall serve only as an agreement of services to be rendered and the fees due thereof. There is no implicit nor explicit indication of an affiliation with Buyer and/or Buyer's other contractees and/or affiliates. The Buyer understands and agrees that if the terms of payment are not met by the Buyer, the Seller will take all necessary efforts to obtain payment using the contact information provided. This information will not be used or shared in any other way except to obtain any outstanding balance(s).
